Minutes of Commission meeting held on October 28, 2008.
~
Present:  Mary vandenBerg, Chairperson, Patricia Caron, Howard Fife, Rolf Hilbig and James Wettlaufer.

7:00 p.m.  Chairperson called the meeting to order.

7:05 p.m.  The minutes of October14, 2008 were read and accepted and will be distributed.

7:07 p.m.  Deborah Olewnik of 11 Shore Dr. questioned whether the project that was approved last year to repair their lakeside wall is still in effect.  The Board readily approved with the same conditions as given previously.

7:10 p.m.  Robert Patnode of 44 Mashapaug Rd., Map 12-A-10 gave us a plot plan from Jalbert Engineering to repair a septic system.  All were in favor of the project.  Mary vandenBerg signed the Procedure Sheet #2008-1307.

7:20 p.m.  Raymond Aquilio of 14 Brandon St., Map R-1-C-6 wants to cut down a swamp maple tree overhanging his porch. All were in favor of the project.  Mary vandenBerg signed the Procedure Sheet #2008-M.

7:25 p.m.  Richard Righetti of 47 Shore Dr., Map R-02-A-18 required help in completing the Request for Determination of Applicability for his project to construct a 16’ x 24’ garage.  He gave us a $70.00 check paying for his Legal Ad.

7:30 p.m.  The continued Public Hearing for a Notice of Intent for Northeast Concepts/Huguenot Farm, Michael LaMountain, DEP File #184-0230, Map 10-A-16,  to “grade and pave driveway apron at 00 Mashapaug Rd., for farmhouse outside resource areas and buffers” was held.  Present: James LaMountain, Peter Frei, Chad Brigham and abutters Karen Raymond and Janet Baldyga.

James LaMountain presented a list of Abutters, Notification to Abutters and Affidavit of Service (to abutters within
300 ft.)

James Wettlaufer disagreed with #6 on Pg. 3 of the Notice of Intent that stated “yes” to the question “was the lot where the activity is proposed created prior to August 1, 1996”.  James LaMountain agreed to change it to “No’ which was then initialed by James LaMountain, Chad Brigham and Board members.

Mr. LaMountain agreed the lot was created by an ANR in 2007 when the land was subdivided to create 2 lots that have subsequently been sold.

The Sherman and Frydryk’s plot plan dated 10-28-08 was reviewed and wetland 100’ and 200’ lines were highlighted for ease of clarification during discussion.

Mr. Fife questioned whether the new plot plan had been submitted to the DEP.  Mr. LaMountain responded that he had received a notice of a complete submission.  At that time he was informed he must submit this new plot plan to the DEP as well.  Mr. LaMountain said to Mr. Fife that he would be filing a suit against him.  Mr. Fife said “don’t threaten me”.

Discussion was had as to the extent of work to be done in the resource area and the construction of a retention area at the base of the access road and Mashapaug Rd.  No written narrative has been submitted for the project.

A site visit was discussed and scheduled for November 1, 2008 at 9:00 a.m.

Mr. LaMountain hesitated to allow the site visit unless the Commission indicated the exact parts of the property to be viewed.  When asked by Mr. Wettlaufer if he was denying the site visit, he responded that he was not, but wanted to know how much of the property would be inspected.  We informed him that the areas subject to the Rivers Protection Act would be looked at.  He does not want any photos taken without his permission.  He was told pictures would be taken of the areas covered by the NOI.

At 8:20 p.m. James Wettlaufer made a motion to continue the Hearing, seconded by Howard Fife and all were in favor.  Petitioners and all were in favor of a continuation to November 25, 2008 at 8:00 p.m.

8:35 p.m.  Mark Farrell of Green Hill Engineering and Glen R. Jobson, builder, presented Mike Santos’ project at Lot #1, Butterworth Rd., Map 05-C-01 to construct a single family house.  Plot plan was reviewed and their being no wetlands issues, Mary vandenBerg signed Procedure Sheet #2008-1311.

8:45 p.m.  Mark Farrell of Green Hill Engineering presented 2 plot plans to repair septic systems with tight tanks;
1)      Paul Wheeler, of 8 Lee Ave., Map R-21-E-1 and
2)      Gerald Jolicoeur of 21 Island Rd. Map R-10-A-24.
Plans were approved.

Rolf Hilbig presented his resignation from the Conservation Commission due to personal situations.

Motion to adjourn was made, seconded and approved by all. Meeting adjourned at 8:55 p.m.
